Draft document
This document still contains bracketed placeholders (e.g. legal entity name, CNPJ, contact emails) that must be completed and reviewed by a lawyer before it is legally binding.
This Privacy Policy explains how [Artemian Legal Entity Name], CNPJ [XX.XXX.XXX/0001-XX] ("Artemian," "we," "us") collects, uses, and protects information when you use our website and Service. Artemian is based in Brazil, and this policy is written to comply with Brazil's General Data Protection Law (LGPD), while also reflecting practices relevant to our clients in the United States and elsewhere.
1. Information We Collect
Account information: name, business name, email address, phone number, and billing address, provided when you sign up.
Content you provide: project photos, project descriptions, business details, and any other material you upload through the Portfolio Manager to be displayed on your website.
Payment information: processed directly by our payment processor (Stripe). Artemian does not store your full card number; we receive limited transaction data (amount, date, status) needed to manage your subscription.
Domain and email data: information required to register or manage a domain name (WHOIS/registrant details) and to provision a professional email account, where applicable.
Usage data: basic technical information such as IP address, browser type, pages visited, and timestamps, collected automatically to operate and improve the Service (see Section 6 on cookies).
Communications: messages you send us via email, contact forms, or support channels.
Founding member applications: when you apply on artemian.cc, we collect your name, company, trade, state, email address, WhatsApp number (optional), and how you get paid today. We use them only to review your application and contact you about it. The application is delivered to us by email through our email provider (Resend); we do not create an account for you and do not add you to a marketing list. Ask us to delete it at any time.
2. How We Use Information
We use the information above to:
- Provide, operate, and maintain the Service (host your site, run the Portfolio Manager, manage your domain/email);
- Process payments and manage your subscription, including billing and renewal notices;
- Communicate with you about your account, service changes, or support requests;
- Improve the Service and troubleshoot technical issues;
- Comply with legal obligations (e.g., tax and accounting records).
3. Legal Basis for Processing (LGPD)
We process personal data based on: performance of the contract we have with you (Art. 7, V, LGPD), our legitimate interest in operating and improving the Service (Art. 7, IX), and compliance with legal obligations (Art. 7, II), as applicable.
4. Sharing of Information
We share information with third parties only as needed to provide the Service:
- Stripe — payment processing;
- Resend — delivers founding member applications from artemian.cc to our inbox by email;
- Microsoft — professional email hosting, where you've opted into that add-on;
- Our hosting and domain registrar providers — to keep your website and domain online;
- Print production and shipping partners — only if you order physical design materials, and only with the information needed to fulfill that order (e.g., shipping address).
We do not sell your personal data. We may disclose information if required by law, subpoena, or to protect our legal rights.
5. International Data Transfer
Because Artemian is based in Brazil and many of our clients are in the United States, your information may be processed and stored outside your home country, including in Brazil and in the countries where our infrastructure and payment providers operate. We take reasonable steps to keep your data secure regardless of where it's processed.
6. Cookies and Similar Technologies
We use cookies and similar technologies to keep you logged in, remember preferences, and understand basic usage patterns (e.g., via analytics tools). You can control cookies through your browser settings; disabling them may affect some features of the Service.
Our website uses PostHog, a product analytics service, to measure page visits and clicks and to record how visitors navigate our pages, including mouse movements and scrolling. What you type into form fields is masked in these recordings.
7. Data Retention
We retain your account and content data for as long as your subscription is active, and for [30] days after cancellation to allow you to request an export, after which it may be deleted from our active systems (backups may persist for a limited additional period for disaster-recovery purposes). Billing records are retained as required by Brazilian tax law.
8. Your Rights
Depending on your location, you may have the right to access, correct, delete, or request a copy (portability) of your personal data, and to object to certain processing. Under LGPD, this includes the right to confirmation of processing, access, correction, anonymization, portability, deletion, and information about entities we've shared your data with. To exercise these rights, contact us at [privacy@artemian.cc].
9. Security
We use reasonable technical and organizational measures (such as encrypted connections and access controls) to protect your data. No system is 100% secure, and we can't guarantee absolute security.
10. Children's Privacy
The Service is intended for business use and is not directed at individuals under 18. We do not knowingly collect personal data from minors.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We'll notify you of material changes by email or through the Service before they take effect.
